The tours are operated by Gürtour (hereinafter called “the company” or “we”), of
Ergenekon Mah. Cumhuriyet Cad. Kamera Center Seyran Apt. No :157/5
Harbiye - Şişli / İstanbul Türkiye and sold subject to
the following conditions:
1- To make a booking you must send us a signed Booking Form and a deposit
of half of the tour price, we will than invoice you for the remainder of the
cost which you must pay not later than 8 weeks before departure. If you book
less than 8 weeks before departure, full payments must be made on booking.
2- If you cancel your booking after you have paid in full and more than 8
weeks before your tour departure, a refund of 50% of the tour cost will be made.
If you cancel less than 8 weeks before your departure, no refund will be made.
We strongly advise you to take out insurance against irrecoverable cancellation
cost.
3- If you are prevented from travelling on the tour you booked by
circumstances such as those which would permit you to make a claim on a normal
cancellation insurance policy, you may transfer your booking to another person
provided they meet all the requirements relating to that tour. Bookings may be
transferred to another person.
4- If you do not pay your balance at the specified time without making
prior arrangements with us we reserve the right to cancel your booking or pursue
any unpaid monies.
5- We will not cancel your tour unless
a) we are forced to do so by unusual or unforeseeable circumstances, such as
flight cancellations, war, civil or political unrest, permits cancellations, or
what is usually known as force major; or
b) because the minimum number of bookings needed to operate the tour has
not been reached or
c) non-payment by client.
Note: All legal regulations like permits, refuses, cancellations are made
by Ministry of Interior and climbing to Ararat is need special permits. In case
of cancellation of permits or cancellation climbing dates or rejecting to
climbing of any person, we pay back all tour cost.
6- If we cancel your tour we will offer an alternative tour; if this is
not acceptable to you we will refund all payments made us in respect of tour
cost and insurance, but we will not be liable to refund you for any incidental
expenses that you may have incurred as a result of your booking, such as visas,
vaccinations, nonrefundable flights etc.
7- Prices of holiday featured may be changed at any time due to changes
in exchange rates, increases in transport or other costs, or if government
action forces us to do so; if you are not notified prior to booking of a price
change, you have the right to cancel and obtain a full refund of all monies paid
to the Company if there is a difference between the price in given and the price
at which holiday is first invoiced to you, provided you notify us in writing 7
days of receiving your invoice.
8- We reserve the right to impose surcharges up to 4 weeks before due to
unfavorable changes in exchange rates, increases in air fares or other transport
costs, or if government action, should require us to do so. Price increases and
surcharges will be calculated according to full extra cost compared to the costs
and exchange rates but we will only surcharge you by the amount which exceeds 5%
of the basic tour cost, except for surcharges required by government action,
which will be charged in full. If any surcharge grater than 10% of the tour
coast is imposed, you have the right to cancel your booking within 7 days of the
notification of the surcharge, and we will than refund any monies paid us in
respect of the tour, but not visas, vaccinations or any other incidentals costs.
If any surcharge is anticipated, you will be advised at the time of booking of
the likely amount.
9- Any information or advice provided by the Company on matters such as
permits, visas, vaccinations, climate, clothing, baggage, special equipment etc.
is given in good faith but without responsibility on the part of the Company,
and the passenger accepts responsibility for obtaining any necessary visas and
travel documents required for the tour.
10- If significant changes to do tour have to be made before departure,
we undertake to inform you, if you do not want to accept the change you can
cancel without penalty. A significant change is a change of more than 24 hours
in departure or return timings or a change in itinerary, transport or
accommodation arrangements affecting more than 10% of the duration of the tour.
11- Your booking is accepted on the understanding that you realize the
hazards involved in this kind of tour, including injury, disease, loss or damage
to property, inconvenience and discomfort. The whole philosophy of this kind of
travel is one which allows alternatives and a substantial degree of on-tour
flexibility. Changes in itinerary may be caused by local political conditions,
flight cancellations, mechanical breakdown, weather, military restricts,
sickness or other unforeseeable circumstances. No refund will be given for
services not utilized. It is a fundamental condition of joining the tour that
you accept this flexibility, and acknowledge that delays and alterations and
their results, such as inconvenience, discomfort or disappointments are possible.
12- On a this adventurous tour it is necessary that you abide by the
authority of the leader, who represents the Company. Signing our booking form
signifies your agreement to this, and if you commit any illegal act when on the
tour or if in the opinion of leader your behavior is causing or likely to cause
a danger, distress or annoyance to others we may terminate your travel
arrangements without any liability on our part. If you are affect your or other
people’s enjoyment of the tour, you must advise us of this at the time of
booking.
13- Before you come on the tour you must be covered by insurance, which
must include adequate cover for baggage, medical expenses and the cost of
repatriation should you become too ill to continue, including helicopter rescue
and air ambulance. Any claims concerning matters for which you are insured must
be directed to your insurers. If you arrive at the start point of the trip
without proof of correct insurance cover, you may not be permitted to continue
with the itinerary, and we will not refund your trip or any other expenses
incurred.
14- If you are joining the tour locally our responsibilities does not
commence until the appointed time at the designated meeting point. If you fail
to arrive there at the appointed time, we shall not be responsible for any
additional expenses incurred by you to meet up with the group. If the group
arrival is delayed to the local joining point the tour shall not be deemed to
begin until the arrival of the group. The responsibility of the Company to a
passenger who is joining the group locally is restricted to supplying
accommodation and food of a plan and standard normal to the tour until the
arrival of the group. The Company is not liable to supply alternative
itineraries or activities during this time. If a passenger is unable, or does
not choose to complete an itinerary outlined for the tour, the Company is not
liable to supply alternative itineraries, excursions, accommodations, services
or staff for the period when client is not present with the group.
15- If you have any complaint about the tour you should make it known at
the earliest opportunity to the leader or our representative, who will normally
be able to take appropriate action. If you are not satisfied with their response
and you feel your enjoyment of the tour is likely to be significantly affected,
you should notify our head office in Istanbul and we will do our best to resolve
the problem. If at the end of the tour, you feel your complaint has not been
properly dealed with, we shall try and agree a settlement with you, but you must
first notify us of your complaint in writing within 30 days of your scheduled
date of return. Any disputed and unresolved complaint may be referred to the low-cost.
16- The company will accept liability for the negligence of its own
employees or agents causing direct physical injury to passengers only to the
extent that is obliged to do so under Turkish Law. We can not be held
responsible for any other mishap to yourself or your property, and in particular
for the consequences or effects of flight cancellations, strikes, wars, riots,
robbery, sickness, quarantine, Government intervention or other such happenings.
Passengers travelling on vehicles owned by the Company are covered by passenger
liability insurance and by signing our Booking form you acknowledge that the
Company has taken all reasonable steps to safeguard its liability in this
respect. You are strongly advise to insure yourself against only other possible
risk that may occur, and in particular to ensure that sufficient insurance
provision has been obtained in respect of any dependent relatives.
17- The Company shall not be liable for any damages caused by the total
or partial failure to carry out tha contract if such failure is
a) attributable to the passenger or
b) unforeseeable or unavoidable and attributable to a third party
unconnected to the Company or
c) a result of unusual and unforeseeable circumstances beyond the control
of the Company, such as strikes, war, civil or political unrest, quarantine
restrictions, military restrictions, government action or what is usually known
as force major or
d) a result of an event that the Company and its agents even with all due
care could not foresee or forestall. Where the Company is found to be liable for
damages in respect of its failureto carry out the contract, the maximum amount
of such damages, compensation and loss of enjoyment will normally be limited to
two times the basic tour price. Any independent arrangements that you make which
are not part of the tour are entirely at your risk.
18- Any flights forming part of the holiday arrangements are subject to
the conditions of the carrying airline, which in most cases limit the airline’s
liability to the passenger in accordance with International Law and conventions.
Our responsibility in respect of air travel is similarly limited to the
airline’s conditions of carriage and in particular, we shall not be responsible
for flight delays or their results, including the consequent amendment or
curtailment of planned itineraries.
19- The booking conditions may only be waived by a Director of the
Company in writing. When you sign the booking form you agree to accept all these
conditions and when we accept your booking we agree to carry out our obligations
to you. Both sides of this agdeement are made subject to and must be interpreted
and enforced according to Turkish Law in a Turkish Court.
20- Any likeness or image of you secured or taken on any of our tours may
be used by the company without charge in all media (wheathernow existing or in
the future invented) for bona fide promotional or marketing purposes, including
without limitation promotional materials of any kind, sucn as brochures, slides,
the internet and video shows.

International prices are not included in the price, and you should arrange
suitable flights or other travel facilities to meet up with the group at the
appropriate time and place. Bookings is normally confirmed within 10 days.

what is in your passport eg name, nationality. And please inform us if any of
the information you give us on this form changes.
